– the withdrawal is notified within 5 days from the date of booking;

– significant modification of one or more main characteristics of the tourist services referred to in art. 34 paragraph 1, letter a) of the Tourism Code, objectively configurable as fundamental for the purpose of the use of the tourist package considered as a whole, proposed by the Organiser to the Customer after the conclusion of the Contract itself, but before departure, and not accepted by the latter;

– the Organiser can no longer fulfil the specific requests made by the Client/Participant and already accepted by the Organiser.

In the above cases, the Customer may:

– accept the alternative proposal where formulated by the Organiser;

– request the return of the sums already paid. Such return must be made within the following 14 days of withdrawal from the Contract.

– In the event of unavoidable and extraordinary circumstances occurring at the place of destination or in its immediate vicinity and which have a substantial impact on the performance of the package or on the carriage of passengers to the destination, the Client has the right to withdraw from the Contract, before the start of the package, without paying cancellation fees, and to a full refund of the payments made for the package,  but he is not entitled to additional compensation.

The Participant has the right to withdraw before the start of the Stay, by means of a notice to be sent to Holiday System by email to info@intersummercamp.it. Following withdrawal, the Organiser will apply the following penalties (the calculation of the days does not include the calculation of the withdrawal days):

The notice of withdrawal must be provided promptly to Holiday System by e-mail to the address info@intersummercamp.it attaching the certification proving the serious reason.

The penalties set out above do not apply in the event that the participant is forced to give up due to his or her own positivity to Covid-19 or in fiduciary isolation due to contact with a positive person, certified by a doctor or competent authority and by a positive swab result. In that case, Holiday System srl will apply a penalty equal to the possible cost of the airline booking which in any case cannot exceed € 400.00 (only in the case of a participant in the Football + English holiday in England).

For the recognition of this right, the reasons must be promptly notified and documented by e-mail to the address info@intersummercamp.it

No refund with respect to the penalties described above will be due to those who cannot make the trip due to the lack or inaccuracy of the required personal documents for entry into the country of destination or expatriation, including the form endorsed by the police headquarters for the expatriation of minors under 14 years of age without parents.

No refund is provided for the Participant who will be removed as a result of violation of even a single clause of these regulations, as well as violation of the law of the host country and/or the internal regulations of the host structure.

No refund is provided for the Participant who has been removed because he or she has been caught committing any crime punishable by law; he will undergo a trial according to the laws of the host country and, if released, will be immediately repatriated at his own expense, if instead he is detained by the authorities, from that moment on any responsibility and/or obligation on the part of the Organizer will cease to be active in promptly notifying the family. Any extra costs will be borne by the participant.

14) Changes or cancellation of the travel package by the organiser

Before the start of the holiday, the Organiser reserves the right to unilaterally modify the conditions of the Contract, other than the price, provided that they are minor changes, communicating them to the Client in a clear and precise manner on a durable medium, such as by e-mail.

If, before departure, the Organiser(s) needs to significantly modify one or more main characteristics of the tourist services referred to in art. 34 paragraph 1, letter a) of the Tourism Code, or (ii) cannot satisfy the specific requests made by the Client and already accepted by the Organiser, the Client may accept the proposed modification or withdraw from the Contract without paying the withdrawal costs.

The Client, who is clearly and precisely informed of the significant change, must communicate his choice to the Organiser within 2 (two) working days from the moment he received the notice; in the absence of communication within the aforementioned deadline, the proposal formulated by the Organizer is considered accepted. In the event that the Client does not accept the replacement package offered, the Organiser will refund without undue delay and in any case within 14 days of withdrawal from the Contract all payments made by or on behalf of the Client/Participant. In addition, the Customer is entitled to be compensated for the non-performance of the Contract, except in the cases indicated below:

– there is no compensation deriving from the cancellation of the tourist package when the cancellation of the same depends on the failure to reach the minimum number of 30 participants;

– no compensation is provided for the cancellation of the tourist package when the Organiser proves that the lack of conformity is attributable to force majeure and fortuitous circumstances and/or in the event of unavoidable and extraordinary circumstances (such as the change of Camp programme, or other change and/or variation, due to a pandemic);

– no compensation is also provided for deriving from the cancellation of the tourist package when the Organiser demonstrates that the lack of conformity is attributable to the Participant or to a third party unrelated to the provision of tourist services included in the Package Travel Contract and is unforeseeable or unavoidable;

It will be the responsibility of the Organiser to communicate, at least 20 (twenty) days before the start date of the chosen period, any modification or withdrawal from the Contract due to failure to reach the minimum number of participants envisaged. In the event of withdrawal due to the occurrence of unavoidable and extraordinary circumstances or force majeure, the Organiser will communicate its withdrawal to the Client without undue delay before the start of the package.

The Organiser has the right to cancel one or more holiday periods in the event of force majeure, such as any government measures to limit the spread of an epidemic. In this case, the Organizer will inform the participants well in advance and refund only the sums already paid by the participant without applying any deduction, management and penalty costs.
